Terms of use and sale

1. Acceptance of the terms

By downloading, installing or using Café Fléchés (the "Game" or the "App"), you agree to be bound by these terms of use and sale (the "Terms").

If you do not accept them, do not install the Game, or uninstall it. The publisher is Enoxys (the "Publisher", "we"), reachable at contact@enoxys.fr.

2. Description of the service

Café Fléchés is a French arrow-word game available on iPhone, iPad and Android devices. It offers 604 grids shipped with the App, split across three sizes (Mini 8×8, Classique 10×10, Grande 13×13) and three clue difficulty levels, together with a daily challenge, streak tracking and statistics per size.

The Game works entirely offline. It requires no account, no sign-up and no server of ours: your progress is saved on your device.

The Game is provided "as is". Its features, its grids and its balancing may change, be modified or be discontinued.

3. Conditions of access

3.1 Age

The Game is rated 4+ on the App Store and PEGI 3 (suitable for all) on Google Play: its content is suitable for all ages.

In-app purchases and rewarded adverts are, however, subject to your app store's rules. Minors should only make a purchase with the agreement of the holder of the payment account, and we encourage parents to use Apple's or Google's parental controls.

3.2 Account

The Game requires no account with the Publisher. An Apple or Google account remains necessary in order to download the App and, where applicable, to make and restore the Premium purchase.

3.3 Hardware requirements

A compatible iPhone, iPad or Android device. No internet connection is required to play; a connection is needed to download the App, to make or restore a purchase, and to display a video advert if you ask for one.

4. Rules of use

4.1 Permitted use

You are authorised to use the Game for your personal, non-commercial use, in accordance with these Terms and with the terms of your app store.

4.2 Prohibited conduct

The following are strictly prohibited:

modifying, decompiling, disassembling or reverse-engineering the App;
extracting, copying or republishing the grids, the clues or the solutions, in whole or in part;
using third-party software, bots, scripts or exploits;
tampering with local data in order to bypass the purchase or hint mechanism;
any unlawful use or use contrary to public order;
maliciously exploiting a defect in the Game — reporting it, on the other hand, is very welcome.

4.3 Sanctions

If these rules are breached, we reserve the right to take any proportionate measure, including reporting the abuse to Apple or Google.

5. Premium: in-app purchase

5.1 Content and price

Premium is a one-off, non-consumable purchase priced at €2.99 including tax (French price tier; the price shown in your country may differ and is the one that applies). There is no subscription, no renewal and no later charge.

Premium gives access to:

unlimited hints;
permanent removal of every advertising offer;
three additional grid styles: Newsprint, Night and Nature;
display of a grid's full solution.

5.2 Handling of the transaction

All purchases are handled by Apple (App Store) or by Google (Google Play), depending on your device. Billing, payment methods, receipts and refunds are governed by those platforms and their terms. The Publisher collects no payment directly and has access to no banking data.

5.3 Restoring the purchase

The purchase is tied to your Apple or Google account, not to the device. You can restore it at any time from the Premium screen or from Settings → Restore purchases, while signed in to the account used for the purchase. A purchase made on the App Store cannot be restored on Google Play, and vice versa: they are two separate stores.

5.4 Right of withdrawal

Premium is digital content supplied immediately upon purchase. Under Article L221-28 of the French Consumer Code, by requesting immediate performance of the supply at the time of purchase you expressly waive your fourteen-day right of withdrawal, and the Publisher hereby informs you of this.

This waiver does not deprive you of the more favourable policies applied by the stores: Apple and Google operate their own cancellation and refund procedures, which may allow longer periods. Any refund request must be addressed to them directly:

iPhone or iPad purchase: reportaproblem.apple.com;
Android purchase: your Google Play order history.

Statutory guarantees of conformity and against hidden defects remain applicable as provided by law.

6. Advertising

The Game displays no banners and no interstitials, and never interrupts a session with an advert.

One free hint is granted per grid. Beyond that, and in the absence of Premium, the Game may offer to let you watch a short video advert in exchange for an additional hint. Watching is entirely voluntary: the Game remains fully usable without ever accepting, and if the advert is unavailable the hint is granted anyway.

These videos are served by Google AdMob, after your consent has been obtained under the conditions described in our privacy policy. The Publisher does not control the content of third-party adverts; inappropriate content can be reported through the network's tools or reported to us by e-mail.

Buying Premium removes this mechanism for good.

7. Intellectual property

7.1 The Publisher's rights

Café Fléchés, its name, its logo, its visual identity, its source code, its texts, its interfaces and all of its grids — their construction, their clues and their solutions are the exclusive property of Enoxys or of its licensors, and are protected by intellectual property law.

The typefaces used (Fredoka, Barlow Condensed, Lora) are distributed by their respective authors under the SIL Open Font License 1.1.

7.2 The licence granted to you

We grant you a personal, non-exclusive, non-transferable, revocable and limited licence to use the Game on devices that you own or control, subject to these Terms and to those of your app store.

7.3 Restrictions

Any reproduction, distribution, publication, adaptation or commercial exploitation of the Game or of its components — in particular the republication of grids or collections of clues — is prohibited without the Publisher's prior written authorisation.

8. Availability and evolution

We endeavour to keep the Game available and working, without guaranteeing uninterrupted access. Availability on the app stores depends on Apple and Google.

We reserve the right to modify, update or remove features and content. A grid corrected by an update may, if you were in the middle of filling it in, start again from scratch: your letters would no longer match the new solutions. Your statistics, your completed grids and your Premium purchase are never affected.

9. Limitation of liability

The Game is provided "as is". We do not warrant that it will be free of errors or interruptions.

To the extent permitted by law, the Publisher is not liable for:

loss of progress or of local data, in particular upon uninstallation, change of device or restoration of a backup;
the content of third-party adverts;
the operation of Apple's or Google's services or stores;
any temporary or permanent unavailability of the Game.

Nothing in these Terms limits the Publisher's liability in the event of gross negligence or wilful misconduct, or for personal injury, nor does it affect the statutory guarantees owed to consumers.

10. Relationship with Apple and Google

These Terms are entered into between you and the Publisher only, and not with Apple Inc. or Google LLC. Those companies are responsible neither for the Game nor for its content.

Apple and Google have no maintenance or support obligation in respect of the Game.
Any claim relating to the Game (conformity, intellectual property, product liability) is a matter for the Publisher.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
In the event of any conflict, the terms of the relevant app store prevail over these Terms as regards distribution and payment.

11. Personal data

The processing of your data is described in our privacy policy, which forms an integral part of these Terms. In short: no account, no collection by the Publisher, progress stored locally, and voluntary rewarded advertising subject to your consent.

12. Changes to the Terms

We may amend these Terms, in particular to reflect changes to the Game or to the law. The applicable version is the one published on this page, whose update date appears at the top. In the event of a substantial change, notice will be given through an update to the App. Purchases already made are not affected by a later amendment.

13. Termination

You may stop using the Game at any time by uninstalling it, which erases all local data. The licence to use then ends. The Premium purchase remains tied to your Apple or Google account and can be restored upon reinstallation.

14. Governing law and dispute resolution

These Terms are governed by French law, without prejudice to the mandatory protective provisions of a consumer's country of residence within the European Union.

Should a problem arise, please write to us first at contact@enoxys.fr: we seek an amicable solution for thirty days before any legal action.

In accordance with Regulation (EU) No 524/2013, European consumers may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Failing agreement, the French courts have jurisdiction, subject to the rules of jurisdiction protecting consumers.

15. Severability

If any provision of these Terms is held void or unenforceable, the remaining provisions remain in full force.
